Welcome to Luna Creative Group. These Terms of Service ("Terms") govern your use of our website and the services we provide. By accessing our website or using our services, you agree to be bound by these Terms.

Our Services

Luna Creative Group provides performance-first marketing agency services, including:

• Acquisition Setup (BUILD): Setting up structured marketing acquisition systems
• Ad Management (RUN): Ongoing management of advertising campaigns
• Creative & Brand Support (CREATE): Creative development and brand strategy
• Website & Landing Pages: Design and development of conversion-focused pages
• SEO Services: Search engine optimization and organic growth strategies

The specific scope, deliverables, and timelines for each service will be outlined in individual service agreements or statements of work.

Service Agreements

Any services provided by Luna Creative Group will be governed by a separate service agreement or statement of work ("Agreement"). These Terms are in addition to any Agreement, and in the event of any conflict, the terms of the Agreement shall prevail.

Each client engagement begins with a strategy call to understand your business goals, current setup, and marketing objectives. Based on this consultation, we will propose a customized marketing strategy and scope of work.

All service agreements must be signed before work commences. Monthly retainer arrangements continue until either party provides written notice of termination as specified in the Agreement.

Payment Terms

• Billing Cycles: Unless otherwise specified in your Agreement, all services are billed monthly in advance. Payment is due within 15 days of invoice date.
• Payment Methods: We accept bank transfers, credit cards, and other payment methods as specified in your Agreement.
• Late Payments: A fee of 1.5% per month (18% annually) will be charged on overdue balances. We reserve the right to suspend services if payment is more than 30 days overdue.
• Refunds: Due to the nature of our services, all fees paid are non-refundable unless otherwise specified in your Agreement.
• Advertising Costs: Media buying costs (e.g., Google Ads, Facebook Ads) are billed at cost plus a management fee as specified in your Agreement. These costs are invoiced in arrears.

Intellectual Property

• Our Property: All pre-existing intellectual property, methodologies, processes, and general know-how owned by Luna Creative Group remains our sole property. We retain ownership of all strategies, frameworks, tools, and materials developed by us.
• Client Property: You retain full ownership of your brand assets, logos, trademarks, and content you provide to us ("Client Materials"). We may use Client Materials solely for providing services to you.
• Deliverables: Upon full payment, you will own the specific deliverables created for you as outlined in your Agreement. We retain the right to use general knowledge, techniques, and experience gained during our engagement.
• Portfolio Usage: With your permission, we may showcase our work in our portfolio and marketing materials. If you prefer confidentiality, please notify us in writing.

Confidentiality

Both parties agree to maintain the confidentiality of all proprietary information disclosed during the course of our engagement. This includes business strategies, marketing plans, pricing, customer data, and any other information marked as confidential.

Confidentiality obligations survive the termination of our engagement indefinitely. We implement appropriate security measures to protect your information and will not disclose your confidential information to third parties except as required by law or as necessary to provide our services.

Limitation of Liability

Luna Creative Group provides marketing services to help grow your business, but we cannot guarantee specific results, outcomes, or return on investment. Marketing performance depends on many factors beyond our control, including market conditions, competition, and your product or service offerings.

To the maximum extent permitted by law, Luna Creative Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities.

Our total liability under any Agreement shall not exceed the total fees paid by you to Luna Creative Group during the twelve (12) months preceding the claim.

Termination

Termination for Convenience: Either party may terminate a service Agreement with written notice as specified in the Agreement. Typically, monthly retainer agreements require 30 days written notice.

Termination for Cause: Either party may terminate immediately if the other party materially breaches these Terms or the Agreement and fails to cure such breach within 15 days of written notice.

Effect of Termination: Upon termination, you remain responsible for payment of all services rendered through the termination date. All confidentiality obligations survive termination.
